I have a question for you...according to the rules: Entrant acknowledges that they do not reserve any rights in and to the Submitted Artwork. Submission of any material further constitutes the entrant’s consent to irrevocably assign and transfer to the Sponsor any all rights, title and interest in the Submitted Artwork, including, without limitation, all copyrights and Sponsor shall have the right to use the Submitted Artwork for any purpose in any manner at any time.
Does this mean that any stock used now belongs to the Sponsor? And can never be used again?? This part has me confused.
That legalize just means that they own the final artwork now. They'll use it when and how they want to without restriction and without paying anyone, myself included. It's like commercial use, but without the satisfaction of making money on it. Even the top prizes in their contest don't involve money or any tangible physical thing of monetary value. The stock used in the deviation is still all yours to do what you want with it, same as if I had made a personal wallpaper using it, then uploaded a screencap of my desktop onto dA, but this has potential to be seen by a larger audience.
OK that is what I thought, but you never know what the lawyers might have in mind, and I am not as versed with legalize as I am with other forms of "talk" like medical terminology...lol So only the "end piece artwork" is what they have control over. Parts going into it is still the original makers as long as they have given permission for commercial use in their rules. Thanks
You got it Ali! SOME of the dA contests have made that as a requirement in the past (with stock images used also becoming owned), but this isn't an official dA contest, it's an official Group contest, and no such clause exists in the language of their Contest FAQ. And if they tried to imply that, after the fact - they'd lose easily in court.
Thank you!
